But section 134 of the Courts Act, following the 1971 amendment, offers, in our view, no such ambiguity, and does not lend itself to any other interpretation than that plainly conveyed by its clear wording » ; « We are fully conscious that by insisting on the plain and obvious meaning of sect. 134 and holding that it does not lend itself to any other reasonable interpretation, we may well be confirming the inconsistency of this enactment with international law. […]. But, as pointed out in Maxwell, the Interpretation of Statutes, 12 Ed., 1969, at p. 185 Find it in your Library, “if a statute is clearly inconsistent with international law or the comity of nations, it must be so construed, whatever the effect of such a construction may be”. / We may also refer to Halsbury, 4 Edn. (Re-issue, Vol. 44(1) where we read, under the topic “Statutory Interpretation” at para. 1439 Find it in your Library : “It is a principle of legal policy that the national law should conform to public international law; so the Court, when considering, in relation to the facts of the instant case, which of the opposing constructions of the enactment would give effect to the legislative intention, should presume that the legislator intended to observe this principle. If, however, an enactment is clear in meaning, it must be construed according to that meaning even if this is contrary to the comity of nations or international law, and whatever the effects upon the rights of aliens not within the jurisdiction may be. Finally, it is beyond dispute that when there is a conflict between Municipal law and International law, a municipal court will apply the Municipal law”.
