I think that this concession was rightly made » at p. 909D-F: “Here the difficulty that arises is when a person is seized in State A by unofficial person or by an unauthorised official of State B and is brought to State B and charged with an offence in State B. By “unauthorised official” I mean an official of State B who acts in the seizure without any authority from State B to do so, as in the present case. That is not an international delinquency since State B itself does not perform or purport to perform any act of Sovereignty in State A. Hence, in my view, the jurisdiction of the municipal courts of State B to try the person seized would not then be affected. Possibly the unauthorised official might be amenable to the civil or criminal municipal laws of State A or B for the seizure, or Stte B might be responsible or deem it diplomatically expedient to release and surrender the person seized, but that depends upon other considerations which need not be considered here”; Rumpff CJ at 911H-912A : “it seems clear that in terms of international law, as it exists (and not perhaps as it should be), the appellants’ case would only have merited consideration if their abduction had been authorised by the Republic of South Africa. […]. In the result it cannot be said that the juridction of the Court a quo was ousted according, to international law […]”

However, without such recognition, the alleged nationalisation and integration of Etlal could not be ackowledged as the acts of the Government of Mocambique, and, for present purpose, would have no greater validity than the seizure of Etlal’s assets by some non-governmental body, having no lawful authority or rights in the matter. In such a situation, the applicant would not have established any right to sue on the sub-contracts, although it might have a claim against that body for the unlawful appropriation of the vehicles (that is, if there were prima facie proof of such appropriation by it)”; 117D-118D [La reconnaissance d’un Etat et d’un government étranger comme acte non justiciable]: “In South Africa, where recognition of a foreign State, or of a government of a foreign State, or of the status of diplomatic representatives of a foreign State, are also matters exclusively within the prerogative of the executive government, the same principles and procedure ought to apply [demande d’information à l’exécutif don’t la réponse fait autorité]” See S v Devoy 1971 (3) SA 899 (A) at 908D-E, where Ogilvie Thompson CJ quoted with approval the statement in O’Connell International Law that: “Recognition is a function of the executive branch of the Government; it is a political act entailing legal consequences…”, and the statement in Starke An Introduction to International Law that recognition is much more a question of policy than of law. / The statutory powers conferred on the executive government by our constitution expressly include that of recognition of diplomatic reresentatives [References]. See also s 2 (1), and especially s 2 (1) (f), of the Diplomatic Privileges Act 71 of 1951. While there appears to be no statutory conferment of the exclusive power of recognition of States and governments, it has always been accepted that foreign relations are essentially embraced within the executive’s prerogative powers. See Sachs v Dönges No 1950 (2) SA 265 (A) per Centlivres JA at 301 and Van Den Heever JA at 308-9. See also the remark of Schreiner JA at 306-7 on the general history and nature of the prerogatives of the executive sovereign. / As to the decisive character of a certificate from the executive, when such is provided, there appears to me to be no logical basis for differing from the rule settled in the House of Lords decisions cited above. […]. It is unnecessary to decide whether a certificate is the only method by which the attitude oof the executive on recognition is to be determined. Where recognition is a matter of judicial cognizance, no certificate or other advice would be required. That would explain the decision in Parkin v Government of the Republique démocratique du Congo and Another 1971 (1) SA 259 (W) where no certificate was laid before the Court and in S v Oosthuizen 1977 (1) SA 823 (N) at 824H, in the paragraph numbered 3, where the Court took judicial cognizance of the ‘fact’ that South Africa had not ‘formally’ recognises Rhodesia. However, as was said in the Duff Development Co case supra loc cit, of there is ny doubt on the matter the practice is for the court to receive information from the appropriate Government Department. / In the present case, following what was said in the SS Arantzazu Mendi case supra loc cit, the Registar of this Court was directed to refer to the Department of Foreign Affairs, and to require that Department to provide a certificate as to whether or not the RPM Government is recognised by the Republic of South Africa. Such a certificate was provided on 27 November 1979. It reads as follows: ‘The Government of the Republic of South Africa recognises the government with its seat at Maputo as the de facto and the jure government of the Popular Republic of Mocamique’. That certificate is conclusive on the matter of recognition”; 120B-C: “there is good reason to believe that the rule of sovereign immunity in international law has undergone an important change, and that the old doctrine of absolute immunity has yielded to the restrictive doctrine, in which immunity is denied in respect of acta jure gestionis involving commercial transactions”; 122B: “This transformation has changed the rules of international law relating to sovereign immunity. So many aheve departed from it that it can no longer be considered a rule of international law. It has been replaced by a doctrine of restrictive immunity. This doctrine gives immunity to acts of a governmental nature, described in Latin as jure imperii, but no immunity to acts of a commercial nature, jure gestionis. Many countries have now adopted it”; 124F: “In my view, it must be accepted that the rule of international law on sovereign immunity which prevails today is that reflected in the restrictive doctrine, and that, in the application of that doctrine, there is no longer any justification for distinguishing,, in the case of commercial transactions, between claims in rem and claims in personam”; 124H : “International law is part of the law of South Africa, save in so far as it conflicts with South African legislation or common law”.

Ltd v Governement of the Republic of Zambia [1980] 2 SA 709 E, 712D-G, Eksteen J : “I turn now to consider the question of the applicability of international law to our law. In South Atlantic Islands Development Corporation Ltd v Buchan 1971 (1) SA 234 (C) at 238 DIEMONT J comes to the conclusion that international law forms part of our law and that it is the duty of the Court to ascertain the rule of international law appropriate to the case under consideration and to administer it. The learned authors of Hahlo and Kahn South African Legal System and its Background express the view at 113 that the Courts will normally apply international law in appropriate cases unless it conflicts with South African legislation or common law. This view was accepted by the Appellate Division in Nduli and Another v Minister of Justice and Others 1978 (1) SA 893 (A) at 906 with the qualification that ‘the fons et origo of this proposition must be found in Roman-Dutch law ». The learned CHIEF JUSTICE then goes on to remark that : ‘‘It was conceded by counsel for appellants that according to our law only such rules of customary international law are to be regarded as part of our law as are either universally recognized or have received the assent of this country, cf Oppenheim International Law vol I 8th ed at 39, 41. I think this concession was rightly made.’ ». In the context of section 35(1), public international law would include non-binding as well as binding law [footnote omitted]. They may both be used under the section as tools of interpretation. International agreements and customary international law accordingly provide a framework within which Chapter three can be evaluated and understood, and for that purpose, decisions of tribunals dealing with comparable instruments, such as the United Nations Committee on Human Rights [footnote omitted], the Inter-American Commission on Human Rights [footnote omitted], the European Commission on Human Rights [footnote omitted], and the European Court of Human Rights [Footnote omitted], and in appropriate cases, reports of specialised agencies such as the International Labour organisation may provide guidance as to the correct interpretation of particular provisions of Chapter Three” ; para 36: “Capital punishment is not prohibited by public international law, and this is a factor that has to be taken into account in deciding whether it is cruel, inhuman or degrading punishment within the terms of section 11(2). International human rights agreements differ, however, from our Constitution in that where the right to life is expressed in unqualified terms they either deal specifically with the death sentence, or authorise exceptions to be made to the right to life by law [References omitted]. This has influenced the way international tribunals have dealt with issues relating to capital punishment, and is relevant to a proper understanding of such decisions” ; para 37 on comparative jurisprudence ; para 39: “In dealing with comparative law, we must bear in mind that we are required to construe the South African Constitution, and not an international instrument or the constitution of some foreign country, and that this has to be done with due regard to our legal system, our history and circumstances, and the structure and language of our own Constitution (The judgment of Kentridge AJ in S v Zuma and Two Others, supra note 6, discusses the relevance of foreign case law in the context of the facts of that case, and demonstrates the use that can be made of such authorities in appropriate circumstances). We can derive assistance from public international law and foreign case law, but we are in no way bound to follow it”.

International law and the contents of international treaties to which South Africa might or might not be a party at any particular time are, in my view, relevant only in the interpretation of the Constitution itself, on the ground that the lawmakers of the Constitution should not lightly be presumed to authorise any law which might constitute a breach of the obigations of the State in terms of international law. International conventions and treaties do not become part of the municipal law in our country, enforceable at the instance of private individuals in our courts, until and unless they are incorporated into the municipal law by legislative enactment1”; § 27: “These observations are supported by the direct provisions of the Constitution itself referring to international law and international agreements. Section 231(3) of the Constitution makes it clear that when Parliament agrees to the ratification of or accession to an international agreement such agreement becomes part of the law of the country only if Parlimanet expressly so provides and the agreement is not inconsistent with the Constitution. Section 231(1) provides in express terms that “[a]ll rights and obligation under international agreements which immediately before the commencement of this Constitution were vested in or binding on the Republic within the meaning of the previous Constitution, shall be vested in or binding on the Republic under this Constitution, unless provided otherwise otherwise by an Act of Parliament”. It is clear from this section that an Act of Parliament can override any contrary rights or obligation under international agreements entered into before the commencement of the Constitution. The same temper is evident in section 231(4) of the Constitution which provides that “[t]he rules of customary law binding on the Republic, shall unless inconsistent with this Constitution or an Act of Parliament, form part of the law of the Republic”. Section 35(1) of the Constitution is also perfectly consistent with these conclusions. It reads as follows: “In interpreting the provisions of this Chapter a court of law shall promote the values which underlie an open and democratic society based on freedom and equality and shall, where applicable, have regard to public international la applicable to the protection of the rights entrenched in this Chapter, and may have regard to comparable foreign case law”. The Court is directed only to “have regard” to public international law if it is applicable to the protection of the rights entrenched in the chapter”; § 28: “The exact terms of the relevant rules of public international law contained in the Geneva Conventions relied upon on behalf of the applicants would therefore be irrelevant if, on a proper interpretation of the Constitution, section 20(7) of the Act is indeed authorised by the Constitution […]”.

This Court, however, may not interpret or construe the treaty, protocol IV or the ancillary agreements, nor may it determine the legal consequence arising therefrom. 3. This Court may not determine the true agreement allegedly concluded between the RSA and GOL. Accordingly, and even if relevant as an issued raised on the pleadings in the action, this Court is unable to construe the agreements between RSA and GOL, nor is it able to determine true agreement between them. Accordingly, and even if raised in the particulars of claim, these issues are not relevant”; at 330D-E regarding act of State doctrine: “The basis for this submission is to be found in the act of State doctrine or in the principle of judicial restraint. Counsel did not refer to any South African Authority in regard hereto. There is none. It is necessary to embark on a consideration hereof by reference to judgments of the USA and the English Courts”; Joffe J at 334D-335A: “The basis of the application of the act of State doctrine or that of judicial restraint is just as applicable to South Africa as it is to the USA and England. The comity of nations is just as applicable to South Africa as it is to other sovereign States. The judicial branch of government ought to be astute in not venturing into areas where it would be in a judicial no-man’s land. It would appear that in an appropriate case, as an exercise of the Court’s inherent jurisdiction to regulate its own procedure, the Court could determine to exercise judicial restraint and refuse to entertain a matter, notwithstanding it having jurisdiction to do so, in view of the involvement of foreign states therein. In the present matter it is apparent that decisions have to be made in regard to the alleged unlawful conduct of GOL in Lesotho and the control of GOL and its relationship with the RSA. As far as the latter is concerned there can be little doubt that this is not an area for the judicial branch of government. It belongs to international law. As was held in Buttes Gas (supra), the Court would be in judicial no-man’s land. It would have no judicial or manageable standards by which to judge the issue. It clearly is a matter in respect of which this Court should exercise judicial restraint. A far as the former is concerned the matter appears to be even more complex. Firstly, the interferences upon wich the plaintiffs rely occurred in Lesotho. The lawfulness or otherwise thereof will have to be determined according to Lesotho law. Secondly, the interferences have all been the subject of litigation in Lesotho. The interferences with the paintiffs’ mining leases in the Rampai area were not disputed. What was and is disputed is the relief which plaintiffs are entitled to as a result thereof. The unlawfulness of the cancellation of the mining leases was conceded. The revocation of the mining leases has been found to be unlawful. Nonetheless, these issues will have to be determined again before this Court. As a result hereof this Court will have to express a view on the lawfulness or unlawfulness of the action of GOL. Tirdly, the conduct of GOL which has to be considered is that of a previous military government and not of the subsequently elected democratic issue. Fourthly, if this Court should decline to entertain the matter it could mean that the plaintiffs would not be able to ventilate their present claim at all. In view of the conclusion to which I have come to in this matter it is not necessary for a finding to be made whether this Court should decline to exercise jurisdiction in respect of the conduct of GOL”.
